Terms and Conditions of Travel (AUD 2018)
Prior to booking a trip with us, please take your time to read and understand the conditions of booking as advised below. It is also strongly recommended that you also read any Trip Notes that relate to your trip before booking to ensure that you have understood the itinerary and style of the trip you will be undertaking.
- Our Contract
By booking a trip with us it is to be deemed that you have agreed to these Booking Conditions and your booking will be accepted on this basis. Services rendered are to be those that are referred to in your booking confirmation invoice.
Pricing, dates and itineraries are valid from 13/02/2017 until 31/10/2017. Beyond 31/10/2017, any prices and itineraries are to be considered indicative pricing only.
- Deposit Requirement
A non-refundable deposit of $250 per person, per trip is required to be paid for your booking to be confirmed. Full payment is due 30 days prior to departure.
- Acceptance of booking and final payments
If your booking is accepted, you will be issued a confirmation invoice. From the date we issue the confirmation invoice, a contract will exist between us. In the event that you have booked within 7 days of departure, the contract is deemed to exist when we have accepted your payment. We reserve the right to treat your booking as cancelled if payment of the balance of the trip price in full is not paid 30 days prior to the departure date.
- Your details
Your booking cannot be confirmed without provision of all requested details and the balance of the trip price. Necessary details to provide us with will include date of birth, full name (as it appears on passport) passport number, nationality and pre-existing medical conditions which could affect your ability to travel.
- Cancellation by the traveller
If you are to cancel your booking cancellation fees will be applicable. A cancellation will only be considered effective when written confirmation of the cancellation is received by us. If you are to cancel your trip:
- 30 days or more prior to departure, we will retain the deposit
- Between 15 and 29 days to departure, we will retain 50% of the total booking cost
- 14 days or less prior to departure, we will retain 100% paid by you in relation to the booking
If for any reason you are to leave a trip after it has commenced, we are not in any way obliged to make refunds for any unused services. If you join a tour after departure, leave prior to its completion or fail to join the tour at all, no refunds will be made.
- Cancellation by us
A trip can be cancelled by us at any time up to 30 days prior to departure, subject to clause 13. A trip may be cancelled at any time before departure if, due to political instability, natural disasters, terrorism, or other external events it is not viable for us to operate with the planned itinerary. If your trip is cancelled by us, amounts paid can be transferred to a different departure date or alternatively receive a full refund. In any circumstances whereby the cancellation is due to external events that are outside of our reasonable control then refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that may incur as a result of you booking your trip including but not limited to visas, vaccinations, travel insurance excess and non-refundable flights.
- Booking Amendments
In the event that you wish to transfer your booking from one trip to another or transfer your booking to a third party we must be notified at least 30 days prior to the proposed departure date.. Transferring a trip booking to a third party is only permitted in circumstances whereby the transferee meets all requirements in relation to the trip, and transfers to a differing departure can only be made to a departure within the current validity period.
The land price of your trip includes:
- All accommodation as listed in Trip Notes
- All transport as listed in the Trip Notes
- Meals and sightseeing as listed in the Trip Notes
- The services of a group leader as described in the Trip Notes
The land price of your trip does not include:
- International or internal flights (unless otherwise specified)
- Taxes, airport transfers and excess baggage charges (unless otherwise specified)
- Meals other than those already specified in the Trip Notes
- Passport and visa fees
- Travel insurance costs
- Optional activities and all personal expenses
- Prices and Surcharges
As is standard practice within the travel industry, our trip prices are subject to seasonal and variable pricing. Demand, market conditions and availability means our trip prices may vary at any time. It can therefore be likely that different prices may have been charged for different people on the same trip. We recommend that if you are pleased with a quoted price, to book at that time. After receiving a quoted price, you are able to lock in that price provided you pay the required deposit by that quote’s expiry date. Discounts or reduced payment offers that become available after your deposit is paid, will not be applicable. If cancelling your booking to take advantage of a differing offer then full cancellation conditions will apply.
- Age and Health requirements
Minimum age restrictions apply to all trips – children under the age of 8 years are not permitted to travel on any trip. The majority of our trips feature no upper age limit at all however we would like to remind you that trips can be physically demanding and a suitable level of physical fitness may be required to allow for full participation. All travellers that are under the age of 18 must be accompanied by a legal guardian, or in circumstances whereby a legal guardian is not in attendance, an escort over the age of 18 that has been appointed by the traveller’s legal guardian. The legal guardian or their designated representative will be considered responsible for the under-age traveller’s day to day supervision and care.
- Small groups and combination trips
Our trips are guaranteed for departure at such time that there are 2 fully paid travellers, unless specifically stated otherwise as a minimum required group size. This means that at times there will be small groups. “Combination” trips can join other existing trips for part or all of the duration. For information pertaining to the number of people booked on your trip please ask us prior to booking your trip.
- Passports and Visas
A valid passport must be carried and you must have obtained all appropriate visas, permits and certifications for Australia . Passports must be valid for 6 months beyond the duration of your trip. Please refer to the Trip Notes for details as is your responsibility to ensure that you are in possession of the correct visas, permits and certificates. If you are refused entry into a Australia because you lack the applicable documentation we are not responsible.
- Travel Insurance
We recommend travel insurance for all of our travellers and this should be taken out at the time of your booking. Travel insurance should provide against medical expenses, death, personal accident and emergency repatriation with a recommended you consult your travel insurance agent for assistance to ensure suitable cover. We strongly recommend that it also covers loss of luggage and personal effects, cancellation, curtailment and personal liability.
- Flexibility and Change of Itinerary
Any itinerary provided by us for your trip is representative of the types of activities contemplated however it is understood that the route, schedules, itineraries and amenities may be altered without prior warning due to local circumstances and/or events or on advice from Parks Victoria.
Prior to departure: If a major change is made we will inform you as soon as is reasonably possible if there is time to do so before departure. A major change is considered to be a change affecting at least 1 day in every 5 days of the itinerary. If a major change is made you may be offered either; the choice to accept the change or to receive a refund of money paid on the land portion of the trip or to accept an alternative trip on offer.
After departure: We reserve the right to make changes to an itinerary after departure due to either local circumstances or events that are deemed beyond our control. If such circumstances are to arise then the additional costs of any required itinerary alterations will be covered by you.
- Authority on tour
A group leader conducts our group trips. The group leader’s decision on all matters likely to affect the well-being or safety of any trip participants. Failure to comply with or interference with a decision made by a group leader is considered grounds for the group leader to direct you to leave the trip immediately, forfeiting any rights to a refund. We will reserve the right to not carry you on any future trips at this point. At all times, compliance with local laws, customs, foreign exchange rules and pharmaceutical/drug regulations is mandatory.
- Optional activities
As per this agreement optional activities not included in the trip price do not form part of your trip or this contract. You agree that any assistance rendered by your group leader or a local representative in arranging an optional activity does not render us liable for them in any way. Any contract for the provision of that activity will be between you and the activity provider only.
- Claims and Complaints
If for any reason you have a complaint regarding your trip please inform your group leader at the time in order to allow them the opportunity to rectify the issue. If you are unable to achieve satisfaction through this method then please submit a written complaint to us within 30 days of completing your tour.
- Photos and Marketing
Images of you taken during the trip may be used by us for advertising or promotional purposes in any media of our choosing. You consent to granting us a perpetual, royalty-free, worldwide and irrevocable licence to use such images for publicity and promotional purposes.
All personal information is treated confidentially and in accordance with all applicable legal regulations. Personal information collected by us may be used for any purpose associated with the operation and booking of a trip or to send you relevant promotional material in relation to special events or offers.
- Applicable Law
The legal regulations of the state of Victoria, Australia govern these booking conditions to the fullest extent allowable. Any dispute arising with a trip or in relation to these booking conditions must be initiated in the courts of the state of Victoria, Australia.
